TIME WOUNDS ALL HEELS
A commentary on poetic justice

After observing this world -- for more decades than I care to mention – one theme prevails above all others. That being what goes around comes around.

History – as far back as records can be found -- is mainly composed of records describing the rise and fall of individuals, societies and empires.

Novels – both factual and fictional – mostly relate how evil doers eventually are vanquished and the do gooders eventually emerge victorious.

Of course this pattern of events need not be by divine decree. After all when people continue to perform acts -- that are damaging to others -- there will eventually be a backlash powerful enough to dethrone -- or even destroy -- the bad guy(s). That is plain human nature at work.

Doing evil -- part of the time -- and good deeds -- part of the time -- merely delays the inevitable. Those that benefit – by evil acts -- will support their benefactors while those that are harmed by those same acts will work against the perpetrator(s). Eventually the part time good guys are vanquished – before their time.

What about -- would-be -- good guys who standby and do nothing while watching innocent hard-working, honest people being abused? What does time do for these useless individuals?

First you can expect the abusers to be removed. Then those -- pseudo good-guys -- who have done nothing to help those victimized might be elevated to the level of the original abusers – especially if the do-nothing crowd -- speak out against the abuse and commit to correcting the damage done.

If the standby good guys are given an opportunity to end the abuse, and compensate those previously victimized – they stand a good chance of holding on to majority support and keeping control of the main issues.

On the other hand if the elevated standby good guys fail to end the abuse – while they have the power to do so -- and merely go through useless gestures pretending they are fulfilling their commitments to correct the problem – then time will catch up with them – and they will return to being the useless stand-by good-guys they have always been. Or worse.

They may delay their downfall, for a while, by doing other good-guy activities part of the time -- but as stated above -- if you do evil things part of the time – and good things part of the time -- payment for the evil doings will still come due eventually.

A prime example of would-be good-guys deposing the evil doers is the election of the Stephen Harper Conservatives in 2006. A main plank -- in their pre-election platform – was the promise of improving the taxation playing field.

This commitment may well have swung enough voters -- victimized by the insidious taxable benefits legislation – from the Liberal Party to the Conservative Party giving the conservatives at least a minority government opportunity.

But an unfunny thing happened on the way to levelling the taxation playing field.

The unfair, unjustified and punitive impact of the flawed taxable benefit was only recognized as being unfair to a mere 30 or so former SDL Optics/JDSU employees in the Saanich Gulf-Islands area of British Columbia.

Out of the tens of thousands of Canadian taxpayers -- also victimized by this same defective legislation – the government only partially and selectively kept their promise to these few hard-working, honest Canadians.

This blatant favouritism is an act that mixes a miniscule good deed with a monstrous example of unequal treatment which is more evil than good. The good/bad pendulum definitely swings to the evil side of the scale for this action.

Of course it would be ludicrous to imply that had the Conservative Government actually fulfilled their offer to level the tax field for all honest, hard-working Canadians bad things -- like the Belinda Stronich affair, and/or the Brian Mulroney/Carl Hans Schreiber incident and/or the Maxime Bernier fiasco – might never have happened.

Then again – who knows what would have happened if the Harper Government had lived up to their promises of Fair Taxation.

Two things -- that would have happened -- for certain being:-

(1) This government’s reputation for keeping its word would be much cleaner.

and

(2) Thousands of honest hard-working Canadians would have their earned rewards restored,
their unjustified tax debt cancelled, their retirement savings back in place, their
peace-of-mind regained and have equal treatment under the law.
These items are their rightful property.

If you also just stand-by and leave the improvement of our government up to someone else then there is no doubt you will also eventually receive the justice you deserve.

Stand up for your right to Fair and Equal taxation, by contacting your Member of Parliament and telling them straight out:- “Change the flawed taxable benefit legislation and restore the tax money extracted for “Income” that never existed – to its rightful owners or look for more bad news at the next federal election.”

Amatter of Ethic...


A MATTER OF HONOUR

with the power to make and/or change our laws,

Wars usually result in the commitment of atrocities and despicable acts by all powers involved.

Decency, honour, compassion are apparently all expendable when the perpetrator(s) of evil acts believe the end justifies the means.

In times when Canada has not been directly involved in an armed conflict our citizens had reason to expect they would be treated with respect and decency by their elected representatives.

During the years of the great, (economic), depression, i.e. 1929 through 1939, many Canadians were evicted from their homes – for non-payment of mortgages, and/or non-payment of property taxes.

As painful as that experience was – little blame could be assigned to our government and/or members of parliament. The great depression was a world wide event that individual nations could not control.

Beginning around the year 2001 – in the middle of the longest running economic boom – once again many Canadians found themselves in financial distress.

Some were obliged to sell, or mortgage their homes, and/or deplete their life savings, and/or cash-in RRSP’s and/or go into debt, and/or, apply for deferment of taxes levied on a theoretical “income” that in fact never existed.

And if a deferment -- of this abusive tax -- was granted then to live with the stress of knowing the deferment could be cancelled at any time -- without warning -- if the related corporation was sold or went out of business.

In the meantime the victim could not move out of Canada, without penalty, regardless of the provisions of the Canadian Charter of Rights and Freedoms.

This time, however, the problem is localized to our own defective “taxable benefit” legislation and total blame is owned by our own government.

To call any member of a government -- that tolerates and perpetuates such injustice and unfairness to any of its citizens – “Honourable” -- is a huge contradiction of definition.

Granting some measure of fairness -- to a prior Canadian government that instigated the defective taxable benefit legislation -- the unfair and unjust aspects of that tax law were not readily apparent until the tech market bubble burst in the year 2000.

The “Competence” -- of those who drafted this defective legislation -- is questionable if they did not recognize the flaw and foresee the possibility of this defect becoming predominant at some future time. And their “Ethics” and “Integrity” are lacking if they did.

When the defect did become apparent ----- by producing unwarranted and devastating taxes on honest, hard-working Canadians and turning a system intended to reward employees -- for their loyalty, long hours of productive service and innovation -- into a personal financial disaster –--- any government staffed by “Honourable” people would have taken immediate corrective action.

Instead proper changes to the law – proposed by the former Prime Minister, (Paul Martin) -- were downgraded to a tax deferment scheme that did absolutely nothing to fix the problem or restore the extorted money to its rightful owners.

When the Conservatives were elected with a minority government in 2006 there was some indication Canadians would have their “Right” to fair taxation restored.

But two years later all but some 30 victims of the defective tax legislation and application are still waiting for any form of real action to level the playing field.

As long as this abuse of Canadian citizens continues – without corrective and, restorative action – then there is only one conclusion to be reached, i.e. “There is not much honour among Canadian politicians – and none among thieves.”

If you would like to see the quality of your government improved then contact your Member of Parliament and inform him, or her, that you demand they and their party commit to correcting this outrageous taxable benefit legislation and those already taxed on non-existent “Income” be properly compensated.

When the Conservative Party won a minority government -- and the Most Honourable Stephen Harper became Canada’s Prime Minister on February 6, 2006 – most Canadians expected there would be another federal election within two years.

Well here it is over two years later and there is no federal election yet in sight. But political pundits do not need to look far to see why. The opposition parties have nothing to offer the Canadian voter that is equal to – or better -- than what the Conservatives have given – which isn’t much.

The opposition parties have searched high and low to find something to go to an election with that might give them a chance at forming the next federal government.

It is difficult to work up much excitement this year over the issue of global warming when Canada has just come through the longest, coldest winter in over half a century.

Then to further lessen public concern about this issue the so-called experts are now predicting that a change in ocean currents will stave off further global warming symptoms for another dozen years or so. (Possibly forever.) So that issue is a non-starter for now.

Getting our troops out of harms way is another sticky issue. There has been a lot of hoop-a-;aw about meeting with the leaders of the Afghanistan dissidents, the Taliban leaders and/or the Hamas leaders to try and negotiate some kind of – let us off the hook -- deal.

As there is a high risk any delegation from Canada may end up becoming hostages, or worse, we need to find some expendable politicians to represent our side. So far there haven’t been any volunteers come forward from our side. (So this issue is a non-starter for now.)

How about energy conservation and renewal?

Who can come up with a plan to replace fossil fuels by an endless supply of energy that can be cornered by investors and keep the economy rolling along like a song? For now higher and higher costs are the most effective means of conserving energy.

Wind power is too little and too unreliable.

Tidal power has prospects for places like The Bay of Fundy.

Geo-thermal sources are great for places like Iceland, Hawaii and Yellowstone Park.

Nuclear Energy is a possible answer for Canada that has a bountiful supply of uranium and some experience with nuclear power plant technology.

But there is a lot of concern regarding the long term safety and environmental pollution associated with nuclear power generation.

Consequently energy conservation – without a suitable replacement plan – is a non-starter issue.

So what issue -- is out there -- to focus public attention upon – that might possibly give any one political party a chance at forming a majority government in Canada?

How about stepping up to the plate on the issue of protecting honest, hard-working Canadians from legalized extortion and economic disaster at the hands of their own government?

After all the Conservative party used “Fair Taxation” as a plank in their 2005 pre-election platform.

And since being elected there have been several speeches -- made by high ranking Conservative Members of Parliament – repeating this same promise.
Stephen Harper, Jim Flaherty, Gary Lunn for example.

In all fairness the Conservatives did take some token measures to keep this promise – at least to about 30 Canadian victims in the riding of Saanich Gulf Islands British Columbia.

The shenanigans carried out so far by the Conservatives -- regarding “Fair Taxation” – are nothing more than publicity stunts with no real substance so far as providing equal relief to thousands of similar victims of the unjustifiable taxes levied on phantom income that never materialized.

Consequently OPPORTUNITY IS KNOCKING for any political party that has the social conscience, the sense of decency, the will to maintain justice and to actually represent the best interest of the Canadians that elected them.

If any Canadian Political Party attempts to excuse their lack of concern, -- and/or tolerance of an abusive tax practice in Canada – on the grounds they were never aware of this problem then you can add lack of respect for the truth as another reason to vote for someone else.

Because every Canadian Political Party in Canada has received multiple E-mails and messages from both individual victims and from the organization:- “Canadians’ for Fair and Equalized Taxation”, (CFET), appealing for equal and fair treatment. If you would like to have Canada governed by Honourable, decent, and trustworthy people then contact your Member of Parliament and tell them you demand a commitment from them and their political party to change the defective taxable benefit legislation and restore all taxes levied on phantom income to it’s rightful owners.

As a Canadian voter:- OPPORTUNITY is KNOCKING - for you as well.

Disasters - Natural and ..

DISASTERS – NATURAL AND MAN-MADE
A commentary regarding obstacles that render the realization of
Every Humans Basic Natural Rights Impossible for some.

When natural disasters strike such as famine, flood, tornadoes or earthquakes there is usually a high casualty level and massive property damage.

The government of more affluent countries usually have a contingency plan to assist survivors of these horrendous events to regain some control over their lives and hopefully begin to recover acceptable living conditions.

There is usually no human error to blame for the loss of human lives or property damage when the earth, the wind and/or water goes on a rampage.

Then following human intervention is generally of a positive nature – with the exception of a minority who go on a rampage of stealing and looting before law and order is restored.

Fortunately humans of this Neanderthal level of morality are seldom persons holding high level positions in government.

A vast majority of humans have a natural instinct to strive for higher levels of social order and a higher standard of personal conduct.

Evidence of that fact is provided by the change in wearing apparel from fig leaves to high fashion clothing and rules of conduct that have changed from taking anything you want from the weak on the basis of might makes right.

A very significant step -- along this march to the ideal society – is the opening paragraph of the American Declaration of Independence where it declares:-

We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness.--That to secure these rights, Governments are instituted among Men, ……

So at this stage of human social evolution the founders -- of the most powerful nation on earth -- believed that a primary function -- of an organized government -- was to assure that those governed would not be denied their Creator-Given rights to:- Life, Liberty and the pursuit of happiness.

Apparently a sufficient number of colonials believed strongly enough -- in that concept -- so as to take up arms and fight against the perceived tyranny of the British Monarchy.

In so doing the colonists eventually won independence from British rule and to a significant degree a better life, greater liberty and a much better prospect of achieving a happy state of mind.

Events leading up to the colonial declaration of independence and the war that followed were – from the British viewpoint -- a man-made disaster.

Abuse of the colonists – to the point where they revolted against British rule – was an avoidable situation. If ordinary common sense had prevailed on the part of the British.

By what idiotic rationale did British authorities, at that time, believe they could impose unfair, unjustified, unreasonable taxes, and oppressive rules and penalties on the colonists with impunity?

It appears the Canadian government has failed to learn from the declaration of independence history lesson and there must be a few Neanderthal thinkers in positions of power in our government.

How else can anyone explain their creating and tolerating tax legislation that imposes huge, abusive, unwarranted, unjustified devastating, punitive, insidious and unfair tax levies on ordinary hard-working Canadians?

Currently invoking rules and penalties on these victims that equal or even surpass those that caused the colonists in America to revolt.

Until now this man-made disaster has been endured because those victimized have been too isolated and too intimidated to become a force to be reckoned with.

Times have changed. Victims are joining forces via the World Wide Web and making their abuse known throughout the Nation and beyond.

When does silence become..


WHEN DOES SILENCE BECOME CENSORSHIP?
Why do Canada’s Radio Talk Shows avoid airing the
Taxable Benefit Issue?

If you tune in to radio broadcast stations such as CFRB in Toronto -- or sister station CFRA in Ottawa -- on most week-day mornings you will hear TALK-SHOW hosts invite the public to call-in and give their opinion on a very wide variety of topics.

In fact I have heard CFRA announce “Call-in to voice your opinion on any topic, suitable for public broadcast”. Or words to that effect. But do not take that invitation at its face value. It is far from the truth.

For example the following is an excerpt from an E-mail I sent to a popular Ottawa, Radio Talk –show host – which is self explanatory.

“ I became involved with the taxable benefits fiasco when I discovered my son had to re-mortgage his house to pay taxes levied on potential but unrealized income.
Then I found there were many other victims of this legalized extortion and thought of you as someone who would take this issue apart and put it together properly.

Imagine my surprise around 11.00 Monday 15 October 2007 when I called you to enlist your support on this issue -- and found myself being cut-up, cut-off and generally made to sound like a kook. Why? (Don't bother to answer that rhetorical question.) It is obvious I either slighted someone's sacred cow -- or touched on a topic that even you are not prepared to tackle. My apology.”


At the time of this incident I thought it was merely the whim -- of the person I called – to evade this issue. Many taxable benefit victims reside in the Ottawa area and therefore the radio show would most certainly receive numerous calls to discuss this topic.

So why would the host verbally attack me when I attempted to accept the broadcast invitation to introduce any acceptable topic? This same host had no compunction when it came to discussing “Women’s Rights”, or, “Kyoto Accord” , or “Same Sex Marriage”, etc.

Just what was the host -- and/or the broadcast station management -- afraid of?

Not long afterward I tried contacting a Toronto radio station – “Talk Show” – via E-mail to try and pave the way to have the taxable benefit issue discussed on CFRB.

That was several months ago and I am still waiting for a reply.

Within the past two weeks I sent another E-mail to the Station Programs management
merely asking if the topic of taxation i.e. per details to be found at:- http://www.cfet.ca
was an acceptable broadcast topic.

This must be a really tough question as I have yet to receive a reply – and still waiting.
(But not holding my breath.)

Well OK. That is only one broadcast organization and they may have a policy of not informing the public when the federal government does something they are not very proud of.

So how about the Canadian Broadcast Corporation, (CBC). That broadcast organization airs Talk-show programs that portend to act as watchdogs on all kinds of issues.
Especially scam issues that the public should be made aware of.

The Communications Director of the “Canadians for Fair and Equalized Taxation”, (CFET) has sent E-mails to invite at least two popular CBC personalities to air the taxable benefits issue. This invitation is at least two weeks old and no reply has been forthcoming to date.

Who would imagine that the fearless commentator from Newfoundland, Rex Murphy and/or Anna Marie Tremonti would keep silent on an abusive tax issue?

So what are we witnessing here?

If a teenage bully was video taped pushing a toddler around and running off with the toddlers toys it would be in the news and on the television by the very next broadcast.
Of course no names would be given to protect the guilty.

But when a government department bullies helpless taxpayers and literally evicts some of them from their homes – that event apparently doesn’t rate reporting.

And the flawed legislation – that makes these punitive tax extortions legal – is apparently not open to public discussion on the radio and/or television. Why not?

Are Canada’s radio and television corporations exposed to some form of intimidation that prevents them from airing opinions on certain government policies, practices and/or shameful conduct?

More than likely the public is denied being informed on such issues because it would hurt corporation advertising revenue.

In other words voluntarily censor your broadcast material -- and eliminate anything that would defame the government and/or the Canadian political system – if you wish to keep selling broadcast time to the government.

If that is the case then do not look to the broadcast media -- in Canada -- to tell you everything that you need to know in order to make a wise choice in any federal election.

IN THIS EVENT THEIR SILENCE IS THE EQUIVALENT OF CENSORSHIP.

Also be aware your candidate for election – to represent your best interests as your riding’s Member of Parliament – WILL MORE THAN LIKELY SELL YOU OUT if the party line does not include a commitment to correct the insidious taxable benefit legislation and restore the unjustified penalties it has fostered.

If you ignore this problem and vote for anyone that has not committed to correcting this blight on the Canadian taxpayer – then do not look any further than your bathroom mirror to find someone to blame -- if this kind of bird eventually visits your roost.

You not only have the right – you have the duty to yourself and fellow Canadians – to hold your elected Member of Parliament accountable for action – or inaction – on government policies and/or practices that abuse Canadians and/or damage Canada’s reputation.

The practice -- of taxing hard-working, honest Canadian taxpayers, into financial oblivion on the pretext the government is entitled to tax money that never existed – is unreasonable, revolting and disgusting beyond words.

What does my MP....


WHAT DOES MY MEMBER OF PARLIAMENT REPRESENT?
A commentary on the Canadian Political System

When a leader, or high ranking member, of a Canadian political party makes a public declaration of government, or party, policy what is he or she actually doing?

Public declarations are seldom, if ever, made off the cuff, by party members, without careful analysis of the probable cost or benefit to the party and/or speaker.

What does total silence -- on an issue that causes unwarranted distress, anxiety, loss of home, unjustified loss of savings, loss of sleep and loss of peace of mind to their constituents – mean?

What does defending defective legislation – that produces all the above listed harm to honest hard-working Canadian Taxpayers mean?

What does ignoring the hundreds – probably even thousands -- of appeals from Canadians victimized by this insidious tax legislation mean?

What does granting an improved measure of fairness to a token few victims of this outrageous tax policy mean?

What does the Honourable Minister of Finance, Jim Flaherty mean by the following words -- to the House of Commons Standing Committee on Finance in his address of January 30 2007 ?

“We made our decision based not on political calculations, as did the previous government, but on principles of tax fairness, balancing the needs of individual investors with the interests of taxpayers and their families. “

“And we acted responsibly and decisively.”

“It is not tax fairness if it is only for a few.”

“And it is not strengthening the economy if the playing field is not level for all businesses.”


Unquote-----------------------------------------------------

Although Minister Flaherty’s speech was made in the context of justifying an amendment of the corporate trust tax legislation – to plug a tax loop-hole – can “the principles of tax fairness” ever be taken out of context?

“Tax Fairness” is applicable to all taxpayers not just to a select few --organizations -- or a select few taxable benefit victims

So what happened to the “responsible and decisive” government action to level the tax playing field for all victims of the taxable benefit legislation?

What became of the governments resolve to level the playing field for all businesses. Is not an employed family wage earner a viable business?

Was all this “level playing field” and “tax fairness” and “responsible and decisive action” talk just political rhetoric to cover a self-serving tax legislation change?

Not a party policy to be applied to all taxpayers that have been treated unfairly, and unequally, and on a severely tilted playing field?
Actions, or in this case lack of action, speak louder than words.

There has been no real substance to any “Tax Fairness” actions taken by the Conservatives, since being elected in 2006.

They have done absolutely zero to level the playing field for all taxable benefit legislation victims.

Each taxable benefit tax victim is still required to submit an appeal – on an individual basis – and cross their fingers hoping for a favourable tax re-assessment.

Do any of the foregoing political shenanigans appear to be real, honest, sincere, representation of any parliament member’s constituent voters?

So far as real concern -- for Canadian taxpayers is revealed by the lack of vocal objections raised and/or action taken to level the playing field -- by our elected Members, (past and present), of Parliament – none is apparent.

SO WHAT DOES OUR MEMBER OF PARLIAMENT REPRESENT?

Silence, and on-going tolerance, of this travesty of justice plainly proves elected representative in parliament are there to look after personal and party interests – and to make speeches that are mainly self-serving rhetoric.

I for one will not just stand there and wring my hands over this situation.

Everyone who asks for my vote -- in the next federal election is being made well aware – commit to correcting this outrageous tax situation – and treating all Canadian taxpayers equally and fairly – or no vote.

Hold your candidate for the next federal election accountable.

Tell your MP straight out:-

Commit to representing the best interests of your constituents. Support correcting the defective taxable benefit legislation retroactively or you will get no support from me.

Speaking in generalities Canada has one of the best systems of government to be found anywhere on earth. The average Canadian would be hard pressed to find reason to complain regarding the treatment and protection they receive from their elected representatives.

But when someone takes a closer look they find there are many Canadians that are being exploited, abused and financially decimated by our government. And until now there was no voice raised in their defence.

From the year 2000 – when the abuse became overpowering – to the present time those who were victimized were told (individually), by their elected representatives the law by which they were being financially and mentally abused was proper and correct.

And if the taxes imposed caused the victim to be literally destitute – then the very fair, compassionate, government, on appeal, might revoke the unjustified taxes -- on a case by case basis.

On the other hand each victim had the possible option of applying for deferment of this obscene tax – on a year-by-year basis – by applying, via form T1212, for deferment of the tax.

But if a tax deferment was granted then the victim became a prisoner in his own land until the tax was paid, or, the victim died.

Whether or not victims accepted that explanation and set of generous options – they were totally ignored by their elected representatives – until a change of government happened in 2006.

The previous regime may have paid a price for their abuse of even a minority of Canadians. Surely there were many victims who did not vote to re-elect those who had exploited and ignored them.

On the other hand the election of the Conservative Party – with a minority government – could well be their reward for putting a Fair Taxation plank in their pre-election platform.

Although actions -- to provide “Fair” taxation -- implemented by the Conservatives -- since their election to power -- have been mainly cosmetic they did in fact deliver, (in part), on their promise -- to some 30+ victims in the riding of Saanich-Gulf-Islands British Columbia.

To thousands of similar tax victims, excluded from this “Fair tax” order, it initially appeared as though the Newly Elected Conservative Government was preparing to deliver “Fair” taxation for all such victims.

But a strange thing happened on the way to fulfilling the “Fair Tax” promise. Excluded victims were being told they did not qualify for the same “Fair Tax” treatment. No valid explanation has been offered for this even more unfair, discriminatory action.

Now it appears the Conservative Government has bigger fish to fry and victimized Canadian Taxpayers are once again being ignored.

But this time circumstances are considerably different.

Victims of the insidious, unfair, obscene, unjustified and defective “Taxable Benefit” legislation have a means of becoming “United”.

They now have a media, (the internet), that gives them a voice to be heard world wide.

They now have a web site and a petition in play by which to organize a powerful political campaign.

They now have widespread media support – in the form of newspaper journalists – who have already published very supportive articles – such as the one by Don Cayo, which appeared in the Vancouver Sun newspaper – under the title:-
“Change the law – don’t just mask the problem”.

Victims are no longer isolated and their plight can no longer be ignored with impunity. They can – and will – have a voice in the next federal election.

It is now a case of “United we Stand”.

The days of “Divided we fall” are over and gone.
